  Anyone hear of a W-4T?

  An employee of one of my clients brought this in to my clients' bookkeeper demanding no withholding.

  It looks like an official IRS form, however, the last form revision is dated November 1998.

  Further, the guy signs it and appends his signature with 'UCC1-207 UCC1-1026 without prejudice'. (Plus uses the 't' in his name to effectively cross out the signature).

  I've advised the bookkeeper that if the employee wants no withholding he should complete & sign a current W-4.

  In the meantime, I was wondering if anyone had heard of this and could give some background/history on when it was last used (if any) as well as any theories on what this scam may be.

  I thought you might like to know that upon further research, it appears that the form W-4T is quite popular with the tax protester crowd.

  You will find that this is not an IRS form. If he will not complete a W-4 I would advise no work.

  Yeah, it's a fairly common hoax from the tax-protester fringe. Just another reason why in-house payroll is more and more a losing proposition. Advise your client to avoid problems by hiring a professional service. They might even find it's cheaper, but at any rate it will head off the vast majority of scams like this.

  I agree. He should be using a payroll service. He definately has the volume and complexity to justify it. Not really sure what the attraction is for him but it's definately psychological. It means something to him to be able to handle payroll 'in-house'. Says it proudly when asked.

  I just continue to suggest.

  Yearly W-4

  I have never heard of this form, but the form W-4 does provide a box for the taxpayer to request exemption from income tax withholding. for the current year. Further the employee is requried to sign the form.

  Sounds like a tax avoidance scheme and the employee should be directed to an attorney for legal advice about what can happen to him/her for pursuing this action. It is easy enough to modify a PDF file with the right graphics program. The 1995 W-4 was probably modified.

  As noted above box 7 on the W-4 allows the taxpayer to declare exemption form income tax withholding but not the FICA and Medicare taxes. This exemption is available if the employee's income under $850.00. Read the section titled "Exemption from Withholding" for more information. Make sure the form is signed and locked in the company safe. If the employee earns over $850.00 a year and refused to sign the 2007 W-4 withhold single and zero.

  The employer should ask himself/herself if they want this employee working for them.
